1. Acceptance of Terms

By using the Ghostmotard.com website, the user declares to have read, understood, and accepted these Terms and Conditions. We reserve the right to modify the terms at any time without notice; the most up-to-date version will always be available on our website.

2. Registration and Account

To make purchases, it may be necessary to create a personal account. The user is responsible for maintaining the confidentiality of their login credentials and assumes responsibility for all activities carried out through their account.

3. Products

The products offered on Ghostmotard.com are described as accurately as possible. However, we do not guarantee that the descriptions are always free of errors or that products are available at all times. We reserve the right to modify prices or withdraw products without notice.

4. Payments and Orders

The prices indicated on the site are expressed in Euros [€] and include VAT, unless otherwise indicated. Shipping costs will be added to the order total. Payments can be made via the methods accepted by the site. All transactions are protected by standard security measures. The submission of an order by the Customer constitutes a binding contractual proposal. Once confirmed and processed by Ghostmotard (status "Processing" or "Shipped"), the order cannot be unilaterally cancelled by the Customer except in cases provided for by the Right of Withdrawal (which applies only after receipt of the goods and with return shipping costs borne by the Customer). Any products made to specific request or personalized (e.g., rim stickers, headlights with specific custom specifications) are excluded from the right of withdrawal pursuant to Art. 59 of the Italian Consumer Code.

5. Shipping

Shipments are made within Italy and internationally, unless otherwise indicated. Delivery times may vary depending on product availability and the destination address. Ghostmotard.com is not responsible for any delays caused by the courier. Products are shipped via selected express couriers. Upon delivery of the goods by the courier, the Customer is required to carefully check:

  • That the packaging is intact, not damaged, wet, or otherwise altered, including the sealing materials.

  • That the number of packages corresponds to what is indicated on the transport document.

Important: Any damage to the packaging or the product must be immediately contested by placing the notation "ACCEPTED SUBJECT TO INSPECTION" (specifying the reason for the reserve, e.g., "punctured package", "crushed package") on the courier's proof of delivery.

Insurance and Limitation of Liability: Ghostmotard offers the option to select insured shipping during checkout.

  • If the Customer chooses NON-insured shipping: Ghostmotard shall not be held liable for loss, theft, or damage occurring during transport attributable to the carrier. In such cases, any reimbursement will be limited to the minimum indemnities provided by applicable law for carrier liability (Art. 1696 of the Italian Civil Code, €1/kg for national transport).

6. Right of Withdrawal

The customer has the right to withdraw from the contract within 14 days of receipt of the products, in accordance with Legislative Decree 206/2005 (Consumer Code). To exercise the right of withdrawal, the user must contact us via email at support@ghostmotard.com and follow the provided instructions. Products must be returned in the same condition in which they were received, complete with original packaging. Return shipping costs will be borne by the customer, unless otherwise indicated.

7. Warranties and Claims

All products sold on Ghostmotard.com are covered by a legal guarantee of conformity. In the case of a defective or non-conforming product, the customer has the right to repair, replacement, or refund. Any claims must be submitted within 14 days of receipt of the product by contacting our customer service.

  • All electronic/LED devices sold are designed to operate exclusively with 12V Direct Current (DC). Connection to Alternating Current (AC) will cause irreversible damage to components (burning of LEDs). Such damage is not covered by the warranty as it is considered improper use of the product.

  • On carburetor models (2 or 4 stroke), the installation of an AC/DC converter or a battery system is required. The warranty exclusively covers defects in Ghostmotard products; therefore, any damage or malfunction arising following use with third-party systems, rectifiers, or components will not be covered by the warranty.

  • Product installation must be performed exclusively by specialized personnel. Ghostmotard declines all responsibility for damage to property or persons resulting from "DIY" (do-it-yourself), incorrect, or non-compliant installation.

8. Limitation of Liability

GhostMotard.com shall not be liable for any direct, indirect, or consequential damages arising from the use or inability to use the purchased products. Our liability for any damages shall in any case be limited to the amount paid by the user for the purchase of the product.

Unless otherwise and explicitly indicated in the product description, items sold on ghostmotard.com are to be considered NOT HOMOLOGATED for use on public roads. The use of such products on public roads may result in administrative fines, withdrawal of vehicle registration documents, or denial of insurance coverage. The Customer is solely responsible for the use of the product and releases Ghostmotard from any civil or criminal liability deriving from improper use on public roads in violation of the applicable Highway Code.

9. Intellectual Property

All content present on Ghostmotard.com (texts, images, logos, graphics, software) is protected by intellectual property rights and may not be copied, reproduced, or used without our written consent.

10. Privacy

The use of personal data is governed by our Privacy Policy, available on the site. By using our services, you accept the collection and use of your personal data as described in the privacy policy.
